TERMS & CONDITIONS
In these Terms and Conditions “we”, “us” and “our” mean My Wicker Pty Ltd (www.mywicker.com.au) and “you” means you the customer. These Terms and Conditions together with your Order constitute the entire Contract between us and you for the supply of Products. The Contract cannot be varied unless we agree to vary it in writing or by email.
Australian Sales Only
We sell and ship products only in Australia. We do not make deliveries outside Australia.
Payment Methods & Processing
My Wicker currently accepts PayPal, Visa card, Master Card, ZipPay and Direct Bank deposit only. Orders cannot be dispatched unless payments are completed and appeared in our accounts, and all the information we need to process the orders.
Zip Pay. Minimum monthly repayments are required. A monthly account fee of $9.95 applies and is subject to change. Pay your closing balance in full by the due date each month and we’ll waive the fee. Available to approved applicants only and subject to completion of satisfactory credit assessment. Other charges may be payable. Fees and charges subject to change. T&Cs apply. Credit provided by ZipMoney Payments Pty Ltd (ABN 58 164 440 993), Australian Credit Licence Number 441878.
GST
All products listed already include GST.
Prices
My Wicker reserves the right to change the price anytime before you place an order. The price of the products shown excludes shipping costs. Shipping cost is shown when you add the product to cart and during order processing. My Wicker reserves the right to change the prices displayed for products on our website at any time. My Wicker reserves the right to cancel orders whose prices are based on erroneous pricing.
Delivery
Estimated delivery time is a guide from our courier partners/companies only. My Wicker makes every effort to deliver your product according to the delivery time provided by our courier partners/companies. The 5 day dispatched time is only valid if all payments and order processing are completed, and excluding public holidays and weekends. The 5 day dispatched guarantee does not imply to pre-order of products.
Warranty and Insurance
My Wicker Warranty is offered in addition to the guarantees provided under Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
We offer 3 years structural warranty, 2 year wicker warranty & 1 year cushion and cover warranty where products are used in domestic environment. Products used in commercial environment are covered by 3 months warranty only. This warranty covers defects in manufacture and materials, but specifically excludes:
(a) Damage caused to the product due to abuse or lack of proper maintenance.
(b) Softening or flattening of the cushions can occur over time, this is considered as normal wear and tear.
We offer free transit insurance on lost or damaged item during delivery and your replacement item be it part or whole will be dispatched within 48 hours after confirmation of lost or damage.
Refund and Returns
We offer return within 14 days of purchase. You will receive the full refund of your item excluding your delivery cost back to you. The return product must be in the same condition and original packaging as when they were shipped.
Consumer Guarantees
Consumer guarantees apply under the Australian Consumer Law.
If a product has a minor defect, we will offer you a replacement part or a refund.
If a product has a major defect, you are entitled to:
– reject the goods and receive a refund
– reject the goods and receive an identical replacement, or one of similar value if available
– keep the goods and receive compensation for the drop in value caused by the problem.
A photo of the defect must be presented to us to assist us with the claim in the warranty department.
If a product is replaced, your replacement item becomes your property and the returned item becomes our property.
When a refund is given, the returned item becomes our property.
My Wicker offers exchange or refund of products, and only process it after we received the returned products.
Our Liablility
To the extent permitted by law:
– We will not be liable for any loss of income, loss of profits, loss of data or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise.
– Our maximum aggregate liability for any Product supplied to you whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the Product(s) in question.
General
You shall not assign any rights and obligations under these Terms and Conditions whether in whole or in part without the prior written consent of My Wicker. Any unauthorised assignment shall be deemed null and void.
If any provision of these Terms and Conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Terms and Conditions and the remainder of the provisions in question shall not be affected thereby. Neither our failure nor your failure to enforce any Term or Condition constitutes a waiver of such Term or Condition. Such failure shall in no way affect the right to later enforce such Term or Condition.
